Refrain from ‘media trial’, free speech must not infringe upon Right to Privacy: Kerala HC



The Kerala High Court has emphasized that while the press has the right to freedom of speech and expression, it should not violate individuals’ rights to dignity, reputation, and privacy, especially when reporting on criminal investigations or court cases. The court clarified that the media cannot act as investigators, prosecutors, or judges and should not preempt official verdicts before the judicial process is complete. It also highlighted the importance of self-regulation by the media to avoid prejudicing fair trial rights or violating the privacy and dignity of those involved. The decision is meant to guide the press on the limits of their freedom in covering criminal cases and promote responsible journalism.
