‘WhatsApp Cannot Be Used As Alternative By Police To Serve Notice To Accused’: Supreme Court



The Supreme Court has ordered all states and Union Territories to issue orders to their police departments, instructing them not to use WhatsApp or other electronic means to serve notices to accused persons. This ruling applies to Section 41A of the Code of Criminal Procedure (CrPC) and Section 35 of the Bharatiya Nagarik Suraksha Sanhita (BNSS). The court emphasized that the prescribed modes of service under the CrPC or BNSS must be followed for issuing such notices. This decision came in response to the Satendar Kumar Antil case, where the court had previously issued directions to prevent unnecessary arrests. The Supreme Court clarified that electronic modes cannot be considered as alternatives to the prescribed modes of service.
