Justices Hrishikesh Roy and S.V.N. Bhatti mentioned that the dam has stood the test of time and is not in imminent danger as claimed by the petitioner, Joe Joseph. However, they acknowledged that the dam’s safety is a longstanding concern. The court had previously addressed similar petitions regarding the dam’s safety, with one petition suggesting lowering the water level to prevent breaching. The potential risk of the dam breaching was highlighted, emphasizing the need to protect the lives and properties of millions of people in Kerala.
