Chief Minister Arvind Kejriwal cannot call for an early election in Delhi without recommending the dissolution of the assembly. Experts have clarified that the Election Commission of India cannot act on the advice of an early election from a sitting government. If the Chief Minister resigns and recommends the dissolution of the House, the Election Commission will begin preparations for the polls. Former officials have emphasized that the Election Commission is not obligated to accept Kejriwal’s suggestion of early polls. Once the government resigns, the Election Commission will decide on the dates for the polls, taking into account various factors like party preparation time, festival schedules, and availability of poll machinery and manpower. The new Chief Minister would need to select their own council of ministers, with the leader of the AAP legislative party needing to stake claim to form a new government.
