Recently, a Delhi court acquitted three brothers accused of running an organized crime syndicate due to improper sanctioning under the Maharashtra Control of Organised Crime Act (MCOCA). The court found that the sanctions were given without proper verification and did not meet the necessary conditions for invoking MCOCA. The prosecution failed to provide sufficient information to satisfy the legal requirements. The court also raised concerns about the confession statement and stated that all sanctions were passed without proper consideration. The accused had spent over 8 years in custody before being acquitted.
