The judge ruled that the prosecutor who brought the charges was illegally appointed. This decision halted the case before the November election. The prosecutor has appealed the ruling, claiming it goes against precedent. Trump’s team argues that the prosecutor, Jack Smith, has been operating unlawfully and without proper oversight. They say Smith’s appointment by Attorney General Merrick Garland was unconstitutional. Similar appointments of special counsels have been made in the past without issue. Trump’s lawyers are also using this argument to try and dismiss another case accusing him of election interference.
