Constructing college on temple land is a benevolent act, says Madras High Court



The Madras High Court has stated that leasing temple lands for constructing a college on a long-term basis can be seen as a charitable act. The court refused to interfere with a notification issued by the HR&CE Commissioner regarding the leasing of land belonging to the Somanathaswamy Temple in Chennai. The petitioner was directed to submit objections/suggestions to the Commissioner. The court previously allowed the functioning of arts and science colleges on temple lands under certain conditions. It emphasized the importance of using temple funds for their intended cause while also supporting education. The petitioner raised concerns about leasing temple lands for college construction while a previous petition on the matter was pending.
